This website is owned and operated by Travel Penticton (TP) and this Agreement governs your use of the Travel Penticton Image bank website.  This website and its contents are intended for tourism businesses. When you download a file from the Travel Penticton online image bank, you are obtaining a standard license that lets you use the file for promotional materials such as advertising, marketing, websites, social media, TV, film, presentations, newspapers, magazines and brochures, that promote tourism in the Penticton area.

The licensing agreement is non-transferable meaning that you cannot transfer or sublicense the images to anyone else.  There are two exceptions which must be identified in the downloading process:

• Employer or client. If you are downloading on behalf of your employer or client, then your employer or client can use the content. In that case, you represent and warrant that you have full legal authority to bind your employer or client to the terms of this agreement.  If you do not have that authority, then your employer or client may not use the content.
• Subcontractors. You may allow subcontractors (for example, your printer or production house) to use content in any production process related to your final project. These subcontractors may not use the content for any other purpose.All of the licensed content is owned by Travel Penticton. All rights not expressly granted in this agreement are reserved by TP and the content suppliers.

Travel Penticton may revise and update these Terms of Conditions at any time and without notice. You are cautioned to review the Terms of Conditions posted on the website periodically. Your continued access or use of this website after any such changes are posted, will constitute your acceptance of these changes.

The use of each photo must include a credit as outlined:  Photo by:  Travel Penticton; accompanied by a caption identifying the location of the image (if available).

You are specifically prohibited to use this website and its contents for Real Estate sales and area development, merchandising, retailing or placing images on any product intended for re-sale.

The above Terms of Conditions govern your use of the Travel Penticton online Image bank and form a legal agreement between you, your company, your employer, your corporate client as the case may be, with Travel Penticton.  By using this website, you confirm that you have read all the Terms of Conditions and that you will abide by and be bound by them.
